A petition for an alien of extraordinary ability must be accompanied by
evidence that you have sustained national or international acclaim and that
your achievements have been recognized in the field of expertise. Such
evidence shall include evidence of a one-time achievement (that is, a major,
internationally recognized award), or at least three of the following:

Documentation of your receipt of lesser nationally or internationally
recognized prizes or awards for excellence in your field of endeavor;
Documentation of your membership in associations in your field, which require
outstanding achievements of their members, as judged by recognized national or
international experts in their disciplines or fields;
Published material about you in professional or major trade publications or
other major media, relating to your work in the field. Such evidence shall
include the title, date, and author of the material, and any necessary
translation;
Evidence of your participation, either individually or on a panel, as a judge
of the work of others in the same or an allied field of your expertise;
Evidence of your original scientific, scholarly, artistic, athletic, or
business-related contributions of major significance in the field;
Evidence of your authorship of scholarly articles in the field, in
professional or major trade publications or other major media;
Evidence of the display of your work in the field at artistic exhibitions or
showcases;
Evidence that you has performed in a leading or critical role for
organizations or establishments that have a distinguished reputation;
Evidence that you have commanded a high salary or other significantly high
remuneration for services, in relation to others in the field; or
Evidence of commercial successes in the performing arts, as shown by box
office receipts or record, cassette, compact disk, or video sales.
If the above standards do not readily apply to your occupation, you may submit
comparable evidence to establish your eligibility.

The immigration law offers the following criteria for initial evidence:

1.Evidence that you are recognized internationally as outstanding in the
academic field specified in the petition, such as
2.Documentation of receipt of major prizes or awards for outstanding
achievement in the academic field;
3.Documentation of your membership in associations in the academic field which
require outstanding achievements of their members;
4.Published material in professional publications written by others about your
work in the academic field. Such material shall include the title, date, and
author of the material, and any necessary translation;
5.Evidence of your participation, either individually or on a panel, as the
judge of the work of others in the same or an allied academic field;
6.Evidence of your original scientific or scholarly research contributions to
the academic field; or
7.Evidence of your authorship of scholarly books or articles (in scholarly
journals with international circulation) in the academic field;
8.Evidence that you have at least 3 years of experience in teaching and/or
research in the academic field.

Experience in teaching or research while working on an advanced degree will
only be acceptable if you have acquired the degree, and if the teaching duties
were such that you had full responsibility for the class taught or if the
research conducted toward the degree has been recognized within the academic
field as outstanding.

NIW 申請要件
To qualify for NIW, you would need to prove that your work or field of
expertise will benefit the interest of US nation as a whole. INS is looking
for realistic evidence of “substantial prospective benefit” to a national
interest item or agenda which specifically sets you apart from others in the
field. Examples of some of the more common factors that tip the scales
favorably:

A sustained record of high achievement—especially of a “national interest”
caliber.
Reference letters from recognized government agencies (especially federal
government agencies), cultural institutions; national or international
organizations, which specifically mention you and explain why your work is in
the national interest.
Articles in major publications about you which denote your achievement in your
filed of expertise or substantiate your reputation.
Proof of substantial citations of your publication by other scientists in the
field.
Published books or articles where you are the primary or first author.
Secured patent(s) or patent application(s) where you are the applicant or one
of the primary applicants.
Proof that your are the head or “critical member” of a team working on a
project of genuine national interest.
Evidence that you are the principal investigator in the project that is funded
by a governmental agency or major scientific organization.
