There were two gulf wars, 10 years apart. it’s a little hard to justify applying the UN resolution for the 1st war to the second war.

The second war initially sold as “Weapons of mass destruction, imminent danger”. After that fell apart, the narrative became “nation building, bring democracy and prosperity to Middle East”. That didn’t pan out either, the last chapter was “contain ISIS, balance Iranian influence and get out dodge”.

But Iraq was no longer occupying Kuwait in 2002. That war was over.

That was because there were no treaties, no agreement (unconditional surrender, in those cases) between the warring parties, so the war lasted till the end.

For Iraq, all major parties signed UN resolution 687 in 1991, which essentially concluded the war. The resolution covered borders between Iraq and Kuwait, sanctions, Iraq liabilities, and removal of chemical and nuclear programs under UN supervision. You can’t come back after 10 years and say “oops, the war wasn’t over”.

That’s why the 2nd war had to be justified with Iraq’s chemical weapon programs, a violation of the UN resolution.
