Please help me with the OPT

can I go back to China after I submit the OPT application. I am planning graduate this May. I already submitted the opt application. As current situation, I have to go back to China for 3 weeks. I want to know do I have any risk to get a visa for caming back? Please help me if you know about this. Thank you very very much!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!

Sorry I don't know much either... At least I can help you to bump this post... Did you hear back from the immigration offfice? I think if your application hasn't been processed yet, it might be OK to go back but will be risky. If you've heard back from them, them most likely the answer is "NO-NO"

Thanks a lot. I've checked the international office in my school today. They said they are not very clear about this situation. So I don't know where can I get help. Actually I haven't t got any response from INS. Any way thanks for your reply.

千万不要冒险！！！上星期才去听了学校办的opt的workshop，被告知政策有变，即使拿到了ead，还必须有找到工作的证明（比如你的offer）才能回来。如果还在找工作，是断断不能出境的。mitbbs上好像也有人贴过了。妹妹还是忍耐一下吧。

I don't want to go back to China either during this special period but it is an emergency. Anyway thanks for all of you. appreciate.

Can I travel outside the US while my OPT application is pending at USCIS?
Before graduation, for example over Spring Recess, you may travel outside the US prior to USCIS approval of your application, if you return to the US prior to graduation.
After graduation, OISS does not recommend travel outside the US prior to receiving OPT approval from USCIS. If you must travel outside the U.S. after graduation, but before you have been approved for your practical training employment, it is advisable to speak with an OISS advisor about the timing of your application and the date you list as the beginning date of the proposed employment. The beginning date selected is important because it has an impact on how early you can apply, thus how early you will obtain approval.
