Second question, h1 and green card holder are almost the same from tax perspective, I am not sure though. I heard h1b can fill in 8833 for tax exemption but never for green card holder. Please double check.
You're better check it out. My understanding is that she will file as H-1 status if her status was H-1 as of 12/31 of that tax year. So you are not eligible for the treaty, which is only for student status.
