学校到底受不受H1名额限制

刚结束一个interview, 是学校的。感觉很喜欢那个工作，interviewer也没有提及h1 issue. 但是我依稀记得当时发resume,在网上确实回答过这么一个问题。。。

Does your current immigration status permit you to legally accept this job immediately and continue the job indefinitely?

我有点confuse乐。。想问问这里的jms, 难道学校也有不sponsor H1的？

Petitions for H1B from higher education institutes or non-profit organization are not subject to the annual cap. However, if the school you mentioned is not higher education institute, it has to be subject to the annual cap. It's also true that many colleges/universities do not sponsor staff position. So, it depends. Good luck to you.

thanks doitnow mm! And, my interviewer said he might call my advisor for reference purpose. Does it mean that I might be given an offer? 有点紧张了。。赫赫。。 [em11]

Just be careful.

I am not sure about the type of your position. Many CA postdocs, staffs,in non-profit organizations,including universities and national labs cannot get H-1B visa. Instead J-1 is the option. I knew somebody had really bad experiences with J-1 visa. A lot of time is wasted dealing with the waiver.

If the position is faculty, normally you willnot have this kind of problem.

To answer your questions, there ARE some universities that donot provide H-1B visa. It depends on your position.

If they do provide you H-1B visa, there is no cap limitation of course.

HIGHER EDUCATION INSTITUE是不受H1B名额限制的. 但不是学校里任何POSITION都可以SPONSOR H1B. 一般至少要3年以上的CONTRACT, 一定LEVEL的SALARY(当然了比INDUSTRY还是少很多, 除非FACULTY). 办H1比办J1对老板来说麻烦多了,而且老板得MAKE THE COMMITTMENT TO HIRE YOU FOR 3 YEARS. 所以很多POSDOC 只拿到J1.

其实老板要做的只是签字，即使是一年的position最后工作中断了，对老伴也没什么影响。许多employer不给办h1，不是能不能的问题，而是想不想的问题，而且很多不想办的完全是心理障碍，以为办h1很费事。我听说有的去加州作博士后的，虽然校方只肯给办j1，结果还是在自己的坚持下自己办了h1，逼着校方签了字就算完事了 [em08]
