怎默算税率呢?


I mean traditional IRA.

Because as they said that will depends on the gross income you get in that year from US. If I will live in China which means I have no gross income in US. The rate for getting out my IRA or 401k is 0%??

well, it's early to worry about things in 30-40 years. laws will change.

BTW, for younger people Roth IRA is better than traditional IRA.

because I decided to buy Roth IRA before. my situation is like, I just started to work in US from July 2004. This year is the first year I fill tax return. I thought I should get refund but I found out I even own them over $300!! So I think maybe I need to change my decision from Roth IRA to traditional IRA so that I can get more tax deductable. The problem is I know the tax rate of me for 2004 is very low(a little over 11%) since the gross income is low. I don't know whether I buy IRA is good idea since I should pay tax when I take that money out when I am 59.5 years old. If that rate is higher than the rate I have now maybe I should not consider traditional IRA. Do you have some suggestions?

first, u must already know the difference about two IRAs:


Roth IRA: use after-tax money, but the return will be tax-free


Traditional IRA: user pre-tax money, no tax before u reach retirement age. but when u retire,i.e. start to take money out of it, u need to pay tax.


Therefore, for 30 years growth/return, Roth IRA is much better. For people who r 10 years or less away from retirement, traditional one is the way to go.


Now come back to tax, did u join 401k program? that will reduce ur tax. And most companies will match some percentage after 1 yr employment(or less). double benefits.

I have 403(b) but no match!!! after deduct my 403(b), my state income tax and other little money. I still owe them!! I always doubt I wrongly fill my form.

well, u really need to talk to a CPA to plan ur tax. For people with no house, no kid and little investment, there're not much to deduct. CPA can tell u what deduction u may have missed and how you should plan for ur future, e.g. buying a house...

I was in my OPT last year but I don't have that $5000 deductable since I changed my status from F2->F1 before.

really?! never heard of this rule. did u find a tax publication said it?

Just did a quick search, china $5000 has the following two restrictions:

b

if within the time limit, the student may claim tax treaty even if s(he) qualifies as "resident alien" for tax purposes but not applicable for permanent resident or immigrant status…standard deduction is lost if treaty is claimed as "resident alien"

c

if treaty benefits are used as a student, they may not be used immediately following as a teacher/researcher

A student, business apprentice or trainee who is, or was immediately before visiting a Contracting State, a resident of the other Contracting State and who is present in the first-mentioned Contracting State solely for the purpose of his education, training or obtaining special technical experience shall be exempt from tax in that Contracting State with respect t

(a) payments received from abroad for the purpose of his maintenance, education, study, research or training;

(b) grants or awards from a government, scientific, educational or other tax-exempt organization; and

(c) income from personal services performed in that Contracting State in an amount not in excess of 5,000 United States dollars or its equivalent in Chinese yuan for any taxable year.

The benefits provided under this Article shall extend only for such period of time as is reasonably necessary to complete the education or training.

I couldn't find some publication says that F2->F1 don't have that $5000 but my friends similiar as me, changed F2->F1->OPT->H1B told me that. So I belive so.

This tells everything. You have to live in China immediately before visiting States, and go to States solely for the purpose of education. Since you had F2 before, your solely purpose was not for education.
